2. About eKultury
-
eKultury is an ecommerce marketplace owned and operated by Kultury Private Limited.
The Platform connects customers with products offered by Kultury and, where applicable,
independent third-party sellers, vendors, brands, creators, or other approved business partners.
-
Certain products may be sold, supplied, invoiced, packaged, or fulfilled by independent
third-party sellers. Where applicable, the seller’s identity and relevant seller information
will be displayed on the product, checkout, order, invoice, or other applicable Platform information.
-
Depending on the transaction and fulfillment arrangement, Kultury may act as the seller,
marketplace operator, or service facilitator. The applicable seller and transaction details
shown on the Platform or invoice will determine the relevant seller responsibilities.
-
Seller-specific responsibilities, including product information, inventory, invoicing, taxes,
fulfillment, shipping, returns, warranties, and other obligations may be governed by separate
Vendor/Seller Agreements and applicable Platform policies.
-
3. Eligibility

You must be legally competent and permitted to enter into a binding
agreement under applicable Indian laws to use the Platform and place
orders.
-
By using the Platform, you represent that the information provided by you

other entity, you represent that you have the authority to act on behalf
of that entity.
-

reasonably required for order processing, payment, delivery,
verification, customer support, or other Platform services.
-
You are responsible for ensuring that the information associated with
your account remains accurate and up to date.

reasonably necessary for account security, fraud prevention, order
processing, seller verification, payment processing, or legal compliance.

-
Products displayed on the Platform are subject to availability. A

successfully confirmed.
-
Product availability may change because of inventory levels, seller
operations, demand, technical issues, or other operational reasons.
-
If a product becomes unavailable after an order has been placed, the
affected order or item may be cancelled and any eligible refund will be
processed in accordance with the applicable payment and refund terms.
-
8. Orders & Order Acceptance
-
Placing an order constitutes an offer by the customer to purchase the
selected product or products subject to these Terms and the applicable
product conditions.
-
An order is considered accepted only after successful order confirmation
by Kultury or the applicable seller, as relevant to the transaction.
-
We reserve the right to refuse, cancel, limit, or modify an order due to
product availability, pricing errors, payment issues, suspected fraud,
incorrect information, seller-related issues, technical errors, or other
legitimate reasons, subject to applicable law.
-
If an order is cancelled after payment has been received, any eligible
refund will be processed through the applicable payment or refund
mechanism.
- 9. Order Cancellation
- Orders may be cancelled by the customer or by Kultury or the applicable seller, subject to the applicable Cancellation Policy.
- Certain orders may not be eligible for cancellation once processing, packing, dispatch, customization, manufacturing, or delivery has commenced.
-
Customized, personalized, made-to-order, or specially prepared products may not be eligible
for cancellation after production or customization has commenced, except where cancellation
is permitted under the applicable policy or required by applicable law.
-
Nothing in this section limits any remedy available to a customer where a customized or
personalized product is defective, damaged, incorrect, materially different from the order,
or otherwise subject to a remedy under applicable law or the applicable return/refund policy.
- 10. Pricing, Taxes & Invoices
-
Product prices displayed on the Platform may change from time to time. The applicable
product price, taxes, delivery charges, discounts, and other applicable charges will be
displayed during checkout before the order is placed.

-
Applicable GST, taxes, duties, cess, or other statutory charges will be applied where required
by law and may vary depending on the product, seller, customer location, and transaction.
-
Where applicable, the seller responsible for the transaction will issue the appropriate invoice
and will be responsible for applicable GST registration, tax collection, invoicing, and other
seller-side tax obligations in accordance with law and the relevant seller arrangement.
-
Customers should review the final order summary and invoice, where provided, for the applicable
price, taxes, delivery charges, discounts, and other charges.
-
11. Pricing Errors
-
Despite our reasonable efforts, an incorrect price, discount, product
description, availability status, or other information may occasionally
appear on the Platform because of technical, typographical, system, or
human error.
-
If an order is placed at an incorrect price or under materially incorrect
information due to such an error, Kultury or the applicable seller may
cancel the affected order, subject to applicable law.
-
Where payment has already been received for a cancelled order, any
eligible amount will be refunded through the applicable payment method or
another permitted method.
-
12. Payments

Payments may be made through payment methods made available on the
Platform, including applicable online payment methods and Cash on
Delivery ("COD"), where available.

gateways, banks, financial institutions, and other authorized payment
service providers.

-
Customers placing COD orders are responsible for accepting the shipment and making the applicable
payment at the time of delivery through the payment method supported by the delivery partner.

Repeated refusal, non-acceptance, fraudulent ordering, false delivery information, or misuse of
COD may result in cancellation of affected orders, restriction or removal of COD availability,
or other appropriate action, subject to applicable law.
-
15. Shipping & Delivery
-
Orders will generally be delivered to the address provided by the
customer during checkout through the applicable seller, warehouse,
courier, logistics provider, or delivery partner.
-
Estimated delivery dates are indicative and may vary depending on
product availability, seller location, processing time, customer
location, logistics network, weather conditions, public holidays,
operational issues, remote locations, government restrictions, or other
circumstances beyond reasonable control.
-
Where an order contains products from different sellers, the products
may be shipped separately and may have different delivery timelines.
-
Further details are provided in the applicable Shipping & Delivery
Policy published on the Platform.
-
16. Delivery Attempts
-
Customers are responsible for providing an accurate and complete delivery
address and being reasonably available to receive the order.
-
Multiple unsuccessful delivery attempts, incorrect or incomplete
addresses, refusal to accept delivery, unreachable recipients, or
failure to provide required information may result in additional
delivery attempts, cancellation, or return of the shipment.
-
Delivery may require OTP verification, signature, identification,
photograph, or another confirmation method depending on the applicable
delivery arrangement.
- 17. Returns, Replacements & Refunds
-
Returns, replacements, exchanges, cancellations, and refunds are governed by the applicable
Return, Replacement & Refund Policy displayed on the Platform.
- Eligibility may vary depending on the product category, seller, reason for return, product condition, customization, warranty, and applicable policy.
-
Customized, personalized, made-to-order, or specially prepared products may be non-returnable
or non-cancellable once production or customization has commenced, except where the applicable
policy or law provides otherwise.
-
A customized or personalized product may still qualify for replacement, refund, or another
remedy where it is defective, damaged, incorrect, materially different from the order, or where
a remedy is otherwise required under applicable law.
- Nothing in these Terms is intended to restrict or exclude any consumer right or remedy that cannot lawfully be restricted or excluded under applicable law.
- 18. Product Condition for Returns
- Where a return is permitted, the product may be required to be unused, undamaged, and returned with its original packaging, accessories, tags, invoices, manuals, and other included items, subject to the applicable return policy.
- Customers may be required to provide photographs, videos, packaging details, or other information to assist with verification of a return, damage, defect, or incorrect product claim.
- Certain products may be non-returnable because of their nature, customization, hygiene requirements, perishability, or other product-specific conditions, subject to applicable law.
-
19. Refund Processing
-
Approved refunds will be processed through the applicable payment method
or another permitted method in accordance with the applicable refund
process.
-
The time taken for a refund to reflect in the customer's account may
depend on the payment service provider, bank, card issuer, financial
institution, or other applicable payment intermediary.

Refunds may be subject to verification and the applicable return,
cancellation, refund, and seller conditions.
